This is in my backyard and looks like a pygmy date palm, but I don't see any dates and it is around 13' tall..

It's definitely a Pygmy. The real name is Phoenix roebelenii. They don't actually grow dates but they are related to the date palm which is a part of the Phoenix  genus.

Thanks Chris, but I have three pygmy's in my front yard with clusters of date like fruit... Does this mean they aren't pygmy's?

It means you have some nice happy palms that are producing seed. They are Phoenix roebelenii but i wouldn't recommend eating them like the true date. Also those look like they're ready to sprout! :D

They are all Phoenix roebelenii. They will produce fruit ("dates") but they aren't tasty like the true date, Phoenix dactylifera.

True edible date palms, P. dactylifera, are not suited to our humid FL climate and will not produce quality fruit even if they survive. They need a desert climate like that of CA. Unless you are looking forward to 1000s of baby pygmy dates taking over your yard you may want to cut off those seeds.

... or give 'em away to folks wanting  to germinate and grow some of their own.
