Bruce posted something interesting in another thread. It was the rules for CA licensing to sell nursery stock. There's an interesting exemption in article 3 that states that if you sell less than $1000 of your own plants for distribution in your own county than you can notify the commissioner of your intent to do so and you are exempt from having to have a license to sell nursery stock. So, thinking about all of the people that you see adverstising plants on Craigslist, in the paper, selling plants at yard sales; who actually does this? I decided to go to the CDFA website and see how one goes about "notifying the commissioner" of ones intent to sell <$1000 nursery stock. No where could I find any such form or even find an email address of the "commissioner". Does anyone know how one goes about doing this? Has anyone ever done this ever? I sell an extra plant or two here and there and as much as I like to be legal the thought of getting on the radar of some government agency is not exactly appetizing. Thoughts?

The COUNTY AGRICULTURAL COMMISSIONER is an enforcing officer of all laws, rules, and

regulations relative to the prevention of the introduction into or the spread within the state of plant

pests and as to such activities is under the supervision of the Secretary of Food and Agriculture.

The County Agricultural Commissioner inspects nurseries for pests injurious to plants and

assists the nurseryman with pest control problems. He/she inspects incoming shipments of

nursery stock, enforces plant quarantines, and inspects nursery stock for proper labeling and

condition.

The County Agricultural Commissioner issues shipping permits, nursery stock certificates,

and other required certificates to facilitate movement of nursery stock in trade.

I have to agree with Braden. License to sell stock is pretty useless imo, BUT I got it anyway. My experience in OC was they came by every 2-3 months to check for fire ants, and check for pesticide storage ( I used not pesticides). They simply set out ant traps with a piece of SPAM in them and come back in a week. I had no ants so no problems. The guy who came to my place always called ahead of time, and was cool. he loved all the tropical stuff.

I think these counties have bigger problems than worrying about backyard growers.
